Exceeding the boundary mining severely damages the environment, a Xiamen company was punished for performing "crazy stones"

Recently, the People’s Court of Tong’an District, Xiamen City, Fujian Province publicly issued a first-instance sentence on the illegal mining of the defendant Xing Leixin Company and the defendants Lin Mouhui, Liang Moushang, and Chen Moujing, and imposed a fine of 200,000 yuan on the defendant.

The Tongan District Court found that between 2013 and 2018, the defendant, Xingleixin Company, and the directly responsible persons in charge, the defendants Lin Mouhui, Liang Moushang, and Chen Moujing, violated the provisions of the Mineral Resources Law and exceeded the mining license.

During the trial of the case, the People's Procuratorate of Tong'an District filed an attached civil public interest lawsuit, demanding the defendant and the defendant to compensate for the ecological damage restoration costs.

The Tongan District Court held that the crime of illegal mining refers to violating the provisions of the Mineral Resources Law, mining without obtaining a mining license, entering the nationally planned mining area, mining areas with important national economic value and other mining areas, or mining without authorization.

Based on the criminal circumstances of the defendant and each defendant, the Tongan District Court made the above-mentioned judgment in accordance with the law.
