Case 1: False publicity of food sales at the Ai Rui Moxibustion Department Store in Maiji District

 

On February 21, 2022, according to the 12315 complaint and reporting clues, the Tianshui Municipal Market Supervision and Administration Bureau conducted a law enforcement inspection of the Airui Moxibustion Department Store in Maiji District and found that the parties took the way of leading people to gather the elderly to watch videos, health lectures, on-site experience products, gifts and other activities, distributed publicity books "Pine Pollen is the Best Medicine", and falsely publicized and sold
ordinary food broken wall pine pollen tablets to treat diseases.
After investigation, a total of 985 bottles of broken wall pine pollen tablets were illegally sold, and the illegal income was 197,000 yuan
.
The conduct of the parties violated the provisions of Article 17 of the Advertising Law of the People's Republic of China and constituted an illegal act
of falsely publicizing the sale of food.
The Tianshui Municipal Bureau of Market Supervision and Administration transferred it to the public security organs for handling
in accordance with the "Provisions on the Transfer of Suspected Criminal Cases by Administrative Law Enforcement Organs".

 

Case 2: Tianshui Taohuagou Bee Industry Co.
, Ltd.
produced and operated food that did not meet food safety standards

 

On December 28, 2021, the soil honey produced by Tianshui Taohuagou Bee Industry Co.
, Ltd.
was inspected by provincial food safety supervision, and the total number of colonies did not meet the requirements of GB 14963-2011 "National Standard for Food Safety Honey", and the conclusion was unqualified
.
After investigation, a total of 50 bottles of local honey were produced, with a value of 1750 yuan, 24 bottles were sold, and the illegal income was 840 yuan
.
The parties' conduct violated the provisions of Article 34(13) of the Food Safety Law of the People's Republic of China

In accordance with the provisions of the first and second paragraphs of Article 124 of the Food Safety Law of the People's Republic of China, the Tianshui Municipal Market Supervision and Administration Bureau made an administrative penalty
of confiscating 25 bottles of unqualified soil honey and 840 yuan of illegal gains, and fining 50,000 yuan.

 

Case 3: Shanghao supermarket chain in Qinzhou District did not purchase salt from a designated wholesale enterprise

 

On March 8, 2022, the Tianshui Municipal Market Supervision and Administration Bureau conducted a law enforcement inspection of Shanghao Supermarket Chain in Qinzhou District and found that the parties concerned did not purchase salt from the salt designated wholesale enterprise, and after verification, 21 bags of Lujing brand pickled salt and 405 bags of refined edible salt of China Salt were unable to provide purchase receipts and supplier qualifications, and the legal source
could not be explained.
The parties' conduct violated the provisions of Article 16 of the Measures for the Monopoly of Salt, constituting an illegal act
of not purchasing salt from a designated salt wholesale enterprise for retailing.
In accordance with the provisions of item (2) of Article 28 of the Measures for the Monopoly of Salt, the Tianshui Municipal Market Supervision and Administration Bureau ordered the parties concerned to immediately correct the illegal behavior, and made an administrative penalty
of confiscating 426 bags of illegally purchased salt and fining 1400 yuan.
