Recently, hubei Provincial Health Department issued a "notice on strengthening the construction of the rule of law in medical institutions throughout the province", clearly will increase the assessment and evaluation of the use of medical personnel, and the results of the assessment of legal knowledge as an annual assessment, regular assessment of physicians, job title promotion and competitive recruitment and other important basis.
The Notice requires that the focus should be on raising the awareness of the rule of law between medical institution leaders and medical personnel, that the principal person in charge of medical institutions is the first person responsible for promoting the construction of the rule of law, that we should take the lead in respecting the law, learning the law, law-abiding and usage, and organize at least one study on the rule of law topic in the central group of the Party Group (CPC) every year, and at least once study the work on the rule of law topic and participate in solving the problem. The practical difficulties in the construction of the rule of law in medical institutions should be made, and the training of legal knowledge should be effectively implemented, including the study of legal knowledge of health and family planning in the training of new staff, standardized training of residents and daily business training, legal knowledge should account for not less than 10% of the proportion of business training, and the staff in medical institutions responsible for handling the legal affairs of the unit should focus on learning legal knowledge for not less than 20 hours per year.
The Notice also calls for strengthening the construction of institutions working under the rule of law in medical institutions, encouraging the establishment of legal affairs departments in medical institutions above the second level, and staffing them with legal expertise and competence according to the size and workload of medical institutions, and having more than two legal professionals in medical institutions at or above the third level.
The Notice makes it clear that the legal counsel system of medical institutions should be implemented, and that each medical institution should apply for full-time lawyers as legal advisers, that practice and services should be strictly regulated in accordance with the law, that rules and regulations should be established and improved, and that the rules of procedure for hospital decision-making should be improved. The Notice also puts forward specific requirements for regulating practice and services, strengthening the supervision and management of medical institutions, and carrying out the construction of model hospitals governed by law and the rule of law.
