    The relevant contents of the Measures are interpreted as follows:


    I.
    What is the background to the promulgation of the Measures?


    Chemical parks are an important carrier for the development of the chemical industry, playing an important role in promoting unified safety supervision, centralized environmental governance, and coordinated development of upstream and downstream, and have become the main development position
    of the chemical industry in our province.
    At present, the development level of chemical parks in our province is uneven, and some parks still have problems such as unreasonable planning and layout, imperfect supporting facilities, insufficient professional supervision capabilities, park identification has not been officially implemented, and there are still doubts about project landing, and the safety environment risk is high, and it is urgent to introduce policies to guide the standardized development of
    chemical parks.


    The provincial party committee and the provincial government attach great importance to the green and safe development of
    chemical parks.
    At the end of 2021, the Ministry of Industry and Information Technology and other six ministries and commissions jointly issued the Administrative Measures for the Construction Standards and Identification of Chemical Parks (Trial), requiring all provinces to formulate chemical park construction standards and identification management measures on the premise that they are not lower than the requirements of the above measures
    .


    II.
    What are the overall considerations for the preparation of the Measures?


    The Measures are mainly based on four considerations: First, fully connect
    with existing policy standards.
    The Measures are based on and higher than the requirements of the Administrative Measures for the Construction Standards and Identification of Chemical Parks (Trial) issued by six ministries and commissions including the Ministry of Industry and Information Technology, guided by relevant national laws and regulations, linked with standards and norms such as safety risk screening and governance guidelines and comprehensive evaluation guidelines for chemical parks, and formulated relevant measures
    closely around the green, safe and coordinated development goals of chemical parks.
    The second is to take into account the characteristics of
    different chemical parks.
    The Measures comprehensively consider the characteristics of different development levels and leading industries in chemical parks and regions in our province, and formulate differentiated policies
    on the basis of ensuring that safety and environmental risks are controllable.
    For example, in the evaluation standards, there are no mandatory requirements for chemical parks that do not require central heating; For chemical parks that do not have the conditions for centralized treatment of hazardous waste, the hazardous wastes generated can be safely used and disposed
    of in combination with the utilization and disposal capacity outside the park.
    The third is to strictly abide by the bottom line
    of safety and environmental protection.
    Facing the needs of intrinsic safety, clean production and emergency support of chemical parks, the Measures put forward binding index requirements from the aspects of park establishment, management agency, park site selection, planning, safety, environmental protection, emergency rescue, etc.

    According to the actual development needs of our province, the Measures clearly stipulate the newly established chemical parks; For the expansion requirements of many places due to insufficient capacity of chemical parks, we have also made clear provisions
    on the expansion of chemical parks in the Measures.


    III.
    What is the basis and main content of the Measures?


    The Measures are mainly based on the Administrative Measures for the Construction Standards and Identification of Chemical Parks (Trial) (Lianyuan [2021] No.
    220 of the Ministry of Industry and Information Technology) and the Guidelines for Safety Risk Investigation and Governance of Chemical Parks (Trial) (Emergency [2019] No.
    78) issued by six ministries and commissions including the Ministry of Industry and Information Technology
    .


    The Measures consist of 7 chapters and 29 articles
    .
    Chapter 1, Article 2 of the General Provisions, puts forward the basis for formulating the Measures, management ownership and the definition of
    chemical parks.
    Chapter II has seven construction standards, which respectively put forward binding index requirements from the aspects of park layout, park planning, park facilities, park management, park safety, park environmental protection, and park development, which are the basic requirements
    that each park must meet through certification.
    Chapter III has four articles for the designation of parks, which clarifies the certification body, recognition procedures, and identification standards of chemical parks, and sets six one-vote veto items
    according to the most basic six conditions in the certification process.
    Chapter IV has four articles on the establishment of parks, which clarify the conditions, approval bodies and approval procedures
    for the establishment of parks.
    It is stipulated that the planned contiguous area of the newly established chemical park shall be more
    than 3 square kilometers (inclusive) in principle.
    This is a hard condition for no chemical industry foundation; For the establishment of chemical parks in places with chemical industry foundations, in addition to meeting the conditions of 3 square kilometers, the area occupied by chemical enterprises in built-up areas should exceed 70%
    at the time of actual certification.
    This is to ensure the dominance of the chemical industry in the chemical park from the source, which is conducive to the coordinated development
    of the chemical industry.
    Chapter V Article 4 of Park Expansion clarifies the conditions, approval bodies and approval procedures for the expansion of the Park (see Article 7 for specific application materials for expansion), and stipulates
    the integration of the Park.
    In principle, the park should not exceed 3 areas after expansion, one is based on the objective existence of multiple parks in the first district of the province, and the other is that the construction of chemical parks should always adhere to the principle of concentration and contiguity, which is conducive to the sharing of
    infrastructure facilities.
    Chapter VI Article 6 of Park Management, clarifying the responsibilities of local and relevant departments, and putting forward requirements
    for the dynamic management of chemical parks, the disposal of chemical parks that have not passed the certification, and safety and environmental protection.
    Chapter VII Supplementary Provision 2 clarifies the interpretation requirements of the Measures and the implementation time of

    IV.
    How to carry out the management of park identification in accordance with the Measures?


    The Measures put forward clear requirements for the establishment, management agency, site selection, planning, safety, environmental protection, emergency rescue, etc.

    of our province in carrying out identification work.
    All localities do a good job in reporting the certification materials, and the Provincial Department of Industry and Information Technology and the members or experts of the Henan Provincial Chemical Park Identification and Management Joint Conference (hereinafter referred to as the Provincial Joint Conference) conduct on-site assessment and scoring to confirm the list of
    certified chemical parks.


    V.
    How to deal with chemical parks that have not passed the certification?


    For chemical parks that have not passed the certification, the following two methods are adopted for disposal
    .
    The first is to order rectification within a time limit in accordance with laws and regulations, improve supporting facilities, and eliminate hidden dangers
    in safety and environmental risks.
    During the rectification period, chemical parks shall not build, renovate or expand chemical projects (except for safety, environmental protection, energy conservation and intelligent transformation projects).

    If the requirements are still not met after the rectification period expires, it shall be closed
    in accordance with laws and regulations.
    The second is to close down in accordance with laws and regulations, no longer undertake chemical projects, properly dispose of existing chemical enterprises in the park, eliminate hidden dangers of safety and environmental risks, and prevent secondary safety accidents and environmental pollution incidents

    6.
    How to manage the newly established chemical park?


    Considering that the relevant supporting facilities of the newly established chemical park have not yet been completed, they do not meet the conditions for passing the certification of the chemical park; If the project is introduced after the completion of supporting facilities, it will lead to a long construction period of the chemical park and the inability of large-scale chemical projects to start in time
    .
    In order to take into account the construction quality of chemical parks and promote the construction of major chemical projects in an orderly manner, the Measures put forward three requirements
    for the newly established chemical parks.
    First, it must be approved by the provincial government; Second, the chemical projects undertaken must be included in the relevant national or local plans and should be approved by the provincial joint meeting; Third, before the chemical projects in the park are put into operation, the newly established chemical parks should pass the certification in accordance with the requirements of the
    Measures.


    7.
    Application materials for the expansion of
    chemical parks.


    (1) Application documents
    for the expansion of the park.


    (2) The basic situation of the park and the expansion area, the land use situation, the project to be implemented, and the guarantee of the elements required for project construction

    (3) The overall development plan and approval documents of the park, the industrial development plan of the park and the demonstration opinions
    .


    (4) Supporting documents for the overall land space planning of the city, county or township where the park is located and the lawful use of land; Relevant map data, including a schematic map of the area after the expansion (with the legally approved land and spatial planning map and satellite image map as the base map), boundary site coordinates (2000 national geodetic coordinate system).


    (5) Planning environmental impact report and review opinions, certification materials
    for the utilization of sewage treatment and capacity expansion in the park.


    (6) Overall security risk assessment reports and expert review opinions
    .


    (7) Planning water resources demonstration reports and review opinions
    .


    (8) The park management plan
    after the expansion.


    (9) Other materials
    that need to be supplemented.


    (10) Letter of commitment to the authenticity of
