In a recent ruling, the European Court of Justice confirmed that BPA must be classified as a substance of high concern. The Luxembourg judge dismissed the complaint of the Plastics Europe Plastics Association.

As the Court explained in its explanatory memorandum, the statute does not preclude the possibility that a substance may be classified as of high concern, although it is used only as an isolated intermediate.
