The new rules for online dining require restaurants to have physical stores.

In order to strengthen the supervision and management of online catering services and standardize the operation of online catering services, the State Administration of Food and Drug Administration has issued the Measures for the Supervision and Administration of Online Catering Services (Draft for Comments) to solicit opinions from the public. The draft opinion suggests that those who use the Internet to provide catering services shall have physical shops and obtain food business licenses in accordance with the law, engage in business activities in accordance with the main business conditions and business projects as set forth in the food business license, and shall not operate beyond the scope.

The draft opinion makes it clear that third-party platform providers should conduct spot checks and monitoring of the business practices and services of catering service providers. If a third-party platform provider discovers that a catering service provider has committed an illegal act, it shall promptly stop and immediately report it to the food and drug supervision and administration department of the people's government at the county level where it is located;
opinion draft suggests that network catering service providers should use non-toxic, clean food containers, tableware and packaging materials, package food, avoid direct contact with food delivery personnel, to ensure that food delivery process food is not contaminated. Reuse of disposable cutlery is prohibited. In addition, food delivery personnel should maintain personal hygiene, use safe and harmless distribution containers, and keep containers clean.
for the network catering service providers of their own websites, the draft opinion suggests that their food business licenses should be publicized in a prominent position on the home page of their websites. The name and address of the online restaurant service provider shall be consistent with the actual store name and address, the published front, lobby, kitchen and other pictures shall be consistent with the physical store;
addition, consumers who order meals through a third-party platform for online food transactions and whose legitimate rights and interests are harmed may seek compensation from the online catering service provider. If the third-party platform provider of the network transaction is unable to provide the real name, address and valid contact information of the food and beverage service provider, the third-party platform provider of the network transaction shall compensate.
