The draft opinion suggests that those who use the Internet to provide catering services shall have physical shops and obtain food business licenses in accordance with the law, engage in business activities in accordance with the main business conditions and business projects as set forth in the food business license, and shall not operate beyond the scope.

addition, consumers who order meals through a third-party platform for online food transactions and whose legitimate rights and interests are harmed may seek compensation from the online catering service provider. If the third-party platform provider of the network transaction is unable to provide the real name, address and valid contact information of the food and beverage service provider, the third-party platform provider of the network transaction shall compensate.
