Fluorine and polyfluoroalkyl substances (PFAS) substances.
The state’s previously announced “Packaging Toxic Substances Act” stipulates that two years after the determination of safer PFAS substitutes, the use of PFAS in food packaging will be prohibited.
In February 2021, the first alternative assessment of PFAS in food packaging was released, and it was determined that PFAS alternative substances can be used for: (1) packaging and lining, (2) plates, (3) boat-shaped lunch boxes, (4) pizza boxes.
The "Application of Food Packaging in the Second Evaluation of Alternative Substances and the Draft of PFAS Candidate Substances" stipulates the definition of five food packaging under consideration by the Ministry of Ecology.
The definition is based on the general functions of food packaging, including:
The definition is based on the general functions of food packaging, including:
• Flatware (a container with a shallow mouth and a flat bottom and a large surface area for holding food),
• Open container (a food container that is closed except for one side),
• Airtight containers (food containers closed on each side),
• Bags and bag handles (containers made of flexible materials),
• Bowl (open container with a wide opening and bottom, allowing food to be scooped with a spoon).
The draft includes a list of candidate alternative substances, which will be evaluated in the second alternative assessment.
When evaluating the use of alternative substances in these food packaging, the Ministry of Ecology will consider information from scientific literature, product and chemical databases, and chemical and food packaging manufacturers.
In addition, the Ministry of Ecology is seeking more information to support its assessment of the hazards, potential risks, technical performance, cost and availability of specific substitute substances or food packaging products containing specific substitute substances.
