The standard playbook of weakly governed countries is universally the same: they capture resource rents themselves while offloading ecological costs onto neighboring countries—or even the entire world. But Mongolia differs from these countries in one crucial way: its ecological costs are not shared globally—they are precisely and directly imposed on China. Frankly, there’s no way around it—geography dictates this reality. The Mongolian Plateau averages 1,500 meters above sea level, whereas the North China and Northeast China plains lie below 100 meters—and the two regions share a 4,700-kilometer border with no major mountain ranges to block airflow. Every spring, as cold Siberian air masses move southward, the Mongolian Plateau functions like a high-power blower positioned directly over northern China. Dust from open-pit mines in southern Gobi, sand loosened by goats’ hooves across central Gobi, and black ash from eastern provinces all plunge southward along a 1,400-meter elevation gradient. Dust lifted in Mongolia at dawn can cross the border by afternoon—and fill Beijing’s streets by midnight. If we comprehensively tally up China’s annual losses—including medical expenditures, extra sanitation costs, work stoppages and delays, accelerated equipment depreciation, and additional environmental remediation spending—the total reaches several billion RMB each year. Some may ask: Given such massive losses, why doesn’t China take the issue to the United Nations? Regrettably, it simply cannot be done. Globally, there are only three international legal frameworks governing environmental issues: the United Nations Framework Convention on Climate Change (UNFCCC), the Convention on Biological Diversity (CBD), and the United Nations Convention to Combat Desertification (UNCCD)—whose COP17 conference was just held in Ulaanbaatar this past August. Yet if you read through all three conventions cover to cover, you’ll find none of them apply to Mongolia. First, international law cannot issue fines. In international trade, if a country engages in dumping, customs authorities can verify shipping documents and factory dispatch records—evidence is concrete, and the WTO can immediately authorize retaliatory tariffs. But how do you investigate a sandstorm? Imagine sitting before an international tribunal where the judge demands proof that “the one ton of sand that entered Haidian District in Beijing and damaged a semiconductor factory’s cleanroom originated specifically from Rio Tinto’s Oyu Tolgoi copper mine.” Can you produce such evidence? Sand mixes invisibly into wind currents—you simply cannot trace individual particles back to their source. Without precise attribution to a specific responsible party, the environmental law principle of “the polluter pays” remains forever unenforceable. Second, national sovereignty restricts external intervention. Under the international legal system, decisions made by a sovereign state within its own territory—including how many mining permits to issue, how many tons of groundwater to extract, how many millions of goats herders may raise, or even which Japanese executives receive entry permits to protected areas—are all considered internal affairs. The Kyoto Protocol sets binding quotas for carbon dioxide emissions—but says nothing about how many goats per square kilometer a country may graze on its grasslands. That means—even if Mongolia completely denudes its grasslands—it retains full authority unless it voluntarily signs away jurisdiction. China cannot send enforcement teams across the border to confiscate goats, nor can it legally claim compensation from Mongolia. Third, the double-standard trap embedded in global climate finance. Per UN design, landlocked developing countries like Mongolia—ecologically fragile and fiscally impoverished—should receive funding from international mechanisms such as the Green Climate Fund and the Global Environment Facility to restore degraded grasslands. But in practice? Western-led international climate funds impose extremely cumbersome approval procedures.

Meanwhile, regardless of whether the mine turns a profit, Rio Tinto annually withdraws management fees of $150–200 million. This is a precision financial scalpel. It slices open the veneer of cooperation—revealing the underlying truth: cash flow is being systematically diverted. In 2022, Rio Tinto spent $3.1 billion to acquire full ownership of the operating company, securing firm control over 66% of the equity. That same year, it ‘generously’ waived approximately $2.4 billion in loans owed by the Mongolian government. But by then, the books had long ceased to reflect reality. Mongolia did try to resist. As early as 2012, Aluminum Corporation of China (Chalco) offered $928 million to acquire a 60% stake in SouthGobi—a mining company located just 40 kilometers from the border. Upon hearing the news, the Mongolian government immediately suspended SouthGobi’s operating licenses. Parliament swiftly passed legislation requiring parliamentary approval for any foreign state-owned enterprise investment exceeding 49% in strategic sectors. Months later, Chalco withdrew its bid, stating bluntly: “Approval is simply impossible.” Behind this maneuver lies Mongolia’s “Third Neighbor” foreign policy—a doctrine pursued consistently for over thirty years. In 1990, U.S. Secretary of State James Baker advised Mongolia to cultivate ties with three distant partners to balance the influence of its two powerful neighbors. Mining development became the most fertile testing ground for this strategy. Choosing Rio Tinto was not merely about price or technology—it was also about acquiring a “Western identity” capable of diluting influence from the south. But the flip side quickly emerged. In 2012, Mongolia’s new government deemed the original contract excessively unfavorable, demanding an increase in its equity stake to 50% and retroactive tax payments. Rio Tinto responded with swift, icy resolve: it halted development of the underground mine—which accounts for 80% of the deposit’s reserves. The key to this treasure trove remained firmly in foreign hands. A breakthrough in the deadlock didn’t occur until 2014. Mongolia’s newly appointed Prime Minister—educated in the U.S.—advocated a clear separation between business and politics. Rio Tinto’s CEO moved negotiations into his own kitchen. Reportedly, the CEO’s nine-year-old daughter entered with a geography homework assignment, asking the Prime Minister to sign her map of Mongolia. That warm, private moment became the icebreaker. Seven months later, the underground mine development agreement was signed—but Mongolia’s desired equity stake and profit-sharing remained elusive. Geological conditions proved far more complex than anticipated; project costs ballooned from $5.3 billion to over $7 billion, delaying production repeatedly—until stable operations finally commenced in March 2023. Meanwhile, Mongolia’s Tax Authority issued near-$400-million tax reassessment notices in 2018 and 2020, prompting both sides to escalate the dispute to international arbitration. The more ore extracted, the clearer the accounts became—and the more apparent it grew that Mongolia’s actual gains were severely limited. 2025 is a nerve-jangling year. Rio Tinto’s copper division posted a 114% surge in profits—reaching $7.4 billion—with Oyu Tolgoi serving as the single largest contributor. Yet in the South Gobi Province where the mine sits, sandstorms have become the new normal. In 2021, an intense sandstorm claimed ten lives and buried hundreds of thousands of livestock beneath yellow dunes.
