[Trend] Multiple U.S. Cities and States Sue Chemical Companies over Per- and Polyfluoroalkyl Substances (PFAS) Contamination

A county in northwestern Georgia has sued chemical manufacturers 3M, EIDP, and Daikin America, as well as carpet manufacturer Mohawk Industries, accusing them of contaminating local landfills with PFAS-containing waste. The lawsuit alleges that Chattooga County further accuses these companies of negligence in handling contaminated waste and failing to warn residents about the potential hazards posed by these persistent chemicals. The county is seeking economic compensation—including punitive damages, attorneys’ fees and costs, past and future damages, and reimbursement for cash expenditures. According to Chattooga County’s complaint, Georgia-based Mohawk and its subsidiaries used branded products containing these chemicals—including Stainmaster, 3M’s Scotchgard, and Teflon—in their manufacturing processes to coat carpets. EIDP formerly operated as E.I. du Pont de Nemours and Company, producing Teflon before splitting into three independent companies in 2015. Chemours Co. now manufactures branded products containing PFAS. The county states that Mohawk boiled carpets to apply PFAS and other chemicals, enhancing stain resistance. After completing this boiling process, the company allegedly disposed of persistent chemical waste at one of several landfills located adjacent to Mohawk’s manufacturing facilities. According to the complaint, this landfill operated from 1979 to 2004 and is now 'soaked in chemicals.' Chattooga County’s landfill collects rainwater, which percolates through decomposing waste to form leachate—a liquid pollutant—that flows into a wastewater treatment plant in Chattanooga, Tennessee. The complaint states that, as of October 15, 2024, various PFAS concentrations in the county’s drinking water significantly exceeded EPA-permitted levels. While the EPA’s PFAS limit ranges from 4 to 10 parts per trillion (ppt), leachate from the county’s landfill measured up to 445 times higher than that threshold. Chattanooga city officials now require Chattooga County to conduct PFAS testing on its leachate and have indicated they are prepared to reject the contaminated liquid due to persistent chemical pollution, according to county court filings. Chad Young, Chattooga County District Attorney, stated in a press release: 'Our community has enjoyed a long-standing, mutually beneficial relationship with carpet manufacturers across North Georgia, and we hope to reach a timely resolution safeguarding our health, property, water, soil, and air. We expect those who polluted our landfills with PFAS to bear the cleanup costs.' Chattooga County is not the only Georgia county suing chemical and carpet companies. According to a press release dated January 23, Gordon County filed a similar lawsuit. Both Gordon and Chattooga Counties are served by the same wastewater treatment plant in Chattanooga. In a related lawsuit, Mohawk filed suit in Georgia state court in November against 3M, EIDP, Chemours, and Daikin America.
