[China Epoxy Resin Industry Online] August 16, 2006: On July 24, the Ministry of Commerce promulgated the new "Regulations on Response to Anti-dumping of Export Products".
Compared with the old regulations promulgated 4 years ago, the new regulations highlight the key points The role that industry associations should play in responding to anti-dumping suits covers almost the entire process of responding.
The new regulations point out: Industry associations should become a bridge between responding enterprises and the Ministry of Commerce.
In addition to the establishment of a statistical supervision and management system for outbound commodities and an information collection and feedback mechanism for trade remedies, an information database for lawyers must also be established.
The new regulations also stipulate that in the process of responding to litigation, industry associations must also organize responding enterprises to participate in hearings, and conduct consultations and negotiations with foreign investigative agencies and relevant industry organizations or enterprises.
Industry associations should also provide assistance on technical issues such as surrogate countries, market economy status, and separate rulings, and on-site inspections by foreign investigative agencies in accordance with the requirements of the responding enterprises.
In order to enable the work to be implemented, industry organizations can, in accordance with the new regulations, set up transfer funds from membership dues for member companies to respond to suits and use them to organize regular training on anti-dumping legal knowledge.
