Revision of drug administration law, intending to severely punish the production and sale of fake drugs and inferior drugs

A draft amendment to the drug administration law was submitted to the Standing Committee of the National People's Congress on Tuesday for deliberation, which will comprehensively increase penalties for the production and sale of fake and substandard drugs The draft adheres to the principle of paying attention to laws and regulations, strengthening the supervision of the whole process, modifying the outstanding problems exposed in the problematic vaccine cases, and responding to social concerns in a timely manner The draft stipulates that the fine for the production and sale of fake drugs shall be more than twice or less than ten times the value of the drugs, and the fine for the serious cases shall be more than ten or less than thirty times; the fine for the production and sale of inferior drugs shall be more than one or less than five times the value of the drugs, and the fine for the serious cases shall be more than five or less than fifteen times the value of the drugs The draft punishes those responsible for serious violations In case of production and sale of fake and substandard drugs, violation of quality management standards and other acts, the legal representative or main person in charge, directly responsible person in charge and other directly responsible persons of the unit shall be punished with confiscation of income, fine, ten years or even life-long prohibition of business.
