Several provisions of the Supreme People's Court on evidence in civil proceedings on intellectual property rights

On November 16, the Supreme People's Court issued "Several Provisions on Evidence in Civil Proceedings on Intellectual Property" (hereinafter referred to as "Regulations on Evidence of Intellectual Property"), and the judicial interpretation will come into effect on November 18, 2020.
the "Regulations on Evidence of Knowledge and Production" is an important measure for the Supreme People's Court to implement the decision-making and deployment of the CPC Central Committee, implement the new development concept, serve high-quality development and strengthen the judicial protection of intellectual property rights.
The Provisions on Evidence of Knowledge and Production adhere to the problem orientation, follow the general rules of evidence in civil litigation, based on the characteristics and actuality of intellectual property litigation, and make provisions on the submission of evidence, evidence preservation, judicial appraisal and protection of trade secrets in intellectual property litigation, so as to appropriately reduce the burden of proof by rightsholders and strengthen the construction of an integrity system for intellectual property litigation.
The promulgation and implementation of the Regulations on Evidence of Knowledge and Production plays an important role in solving the problem of "difficult to prove" in intellectual property litigation, reducing the cost of defending rights, improving the quality of judicial protection of intellectual property rights, and promoting the creation of a market-oriented, rule-of-law and international business environment.
